STATUTE

I. GENERAL PROVISIONS

  1. This regulations (hereinafter referred to as the "Event Regulations") have been issued based on the provisions of the Act of 20 March 2009 on the safety of mass events, published in the Journal of Laws of 2009, No. 62, item 504, as amended (hereinafter referred to as the "Act"), and other regulations whose provisions have a direct impact on the organization of the Event and its course.

  2. The regulations are issued by the organizer of the event under the name: SUMMER END FESTIVAL, which will take place from August 25th to 27th, 2023, in the area of Zalesie Górne (hereinafter referred to as the "Event"). The organizer of the Event is the "Remote Foundation," located at 29 Długa Street, 00-238 Warsaw, correspondence address: 29 Długa Street, 00-238 Warsaw (hereinafter referred to as the "Organizer").

  3. The regulations are intended for all individuals who will be present on the premises where the Event takes place during its duration. Each person present on the premises during the Event is obliged to comply with the provisions of these regulations.

  4. The purpose of these regulations is to ensure the safety of the Event by defining the rules of conduct for individuals present at the Event, using the premises where the Event takes place, and utilizing the facilities located on the premises. Additionally, the purpose of the regulations is to regulate the rights and obligations of the Event participants in connection with the purchase of entrance tickets to the Event.

  5. The following definitions used in these regulations shall have the following meanings:

  • "Ticket" means an individual permission to enter the event premises - in the appropriate sector designated for the audience. Upon the first entry to the event premises, the Ticket will be exchanged for a control coupon and converted into a wristband allowing for unlimited entry and exit to the Event premises (applicable to both one-day and two-day passes).

  • "Event Premises" means the enclosed area where the Event takes place.

  • "Event Participant" means a person participating in the Event based on a valid ticket, invitation, or identification issued by the Organizer. An Event Participant can be an adult or a minor under the supervision of an adult. A minor is present solely under the responsibility of an adult guardian under whose care they remain, after acquiring tickets for both themselves and the minor.

  • A minor is a person who has not yet reached the age of 18 (Article 10 of the Civil Code).

II. TICKET SALES

  1. Ticket sales are conducted through online sales - www.summerendfestival.com, www.goingapp.pl, and www.empikbilety.pl.

  2. Tickets can only be sold at the price printed on the Ticket. Reselling Tickets at a higher price than printed on the Ticket is prohibited. Reselling Tickets at auctions, bids, contests, profit-oriented resale outside authorized sales points, etc., is also prohibited.

  3. The Organizer informs that according to Article 133 of the Act of 20 May 1971, the Misdemeanor Code: "Anyone who acquires admission tickets to artistic, entertainment, or sports events for the purpose of resale at a profit, or who sells such tickets at a profit, shall be subject to arrest, restriction of liberty, or a fine. Attempting, instigating, aiding, and abetting are punishable."

  4. The Organizer warns that presenting an inauthentic ticket by an Event Participant will result in denial of entry to the Event.

  5. The right to enter the event premises will be granted only to individuals possessing an original ticket acquired in accordance with the provisions of this regulations.

  6. Tickets acquired in violation of the provisions of the Regulations may be invalidated by the Organizer, without the right to a refund of payment.

III. ENTRY TO THE EVENT PREMISES

  1. Entry to the Event Premises is granted to individuals possessing Tickets, which will be deprived of a control coupon upon the first entry. Participants will then receive a wristband.

  2. A Ticket without a control coupon and wristband must be carried by the Participant. In the case that the Event Participant is a minor (a person who has reached 16 years of age) aged between 16 and 18 years, they can only attend the Event under the supervision of an adult.

  3. The Organizer sets the design of the wristband, and the Participant is obliged to wear the wristband on the arm within the event premises in a way that enables rapid identification of the event participant. The wristband may only be used by one person, transferring the wristband is prohibited. Damaging, tearing, losing, or stealing the wristband will result in its invalidation.

  4. The Event Organizer can deny entry to the Event and the presence on it to individuals:
    a) without a ticket along with a wristband,    b) visibly under the influence of alcohol, intoxicating substances, psychotropic substances,          or other similarly acting substances,    c) possessing weapons or other items, materials, products, beverages, substances as mentioned in Chapter IV point 7 of the Regulations,    d) displaying any form of violence and discrimination, behaving provocatively and unculturedly, or in any other way posing a threat to the safety or order of the Event,    e) in sportswear or dangerous attire (tracksuits: pants or sweatshirt; shoes with metal endings),    f) possessing whistles, horns, and other noisy gadgets,   g) whose outward appearance prevents identification,h) possessing plastic or glass containers, cans, etc., and possessing other dangerous items,i) not having an identification document (ID card, driver's license, or passport).

  5. Entry to the event premises is allowed for individuals presenting an appropriate ticket along with a wristband or an identifier along with a wristband issued by the organizer.

  6. Entry to the event premises is only granted to individuals who are 18 years old on the day of the event. For younger individuals (who have reached 16 years of age), in order to enter the festival grounds, they must have the following documents:
    - Proof of identity (ID card, driver's license, or passport)
    - Photocopy of the parent's proof of identity (ID card, driver's license, or passport)
    - Signed consent of the parent for the child's participation in the event, indicating under whose care the child will be at the festival (name and surname of the adult)
    School or student IDs are not considered proof of identity and will not be accepted at the gates.
    Children up to 10 years old under the care of parents have the right to free entry to the Summer End Festival premises.

  7. If during the Event, within the territory of the Republic of Poland or within its specified area, regulations establishing specific restrictions, orders, or prohibitions for organizers of cultural and entertainment events during the SARS-CoV-2 epidemic in Poland are in force, the Organizer reserves the right to allow entry to the event based on regulations established by the relevant state authorities.

IV. ORGANIZATIONAL AND ORDER RULES APPLYING ON THE EVENT PREMISES

1. The Organizer will designate zones with limited access or accessible only to guests and organizer's personnel.

2. On the event premises, gastronomic points will be distributed within designated gastronomic zones.

3. The Organizer ensures the safety of individuals present at the Event and maintains order during the Event by means including, but not limited to:

   a) security and information services identifiable by their attire,
   b) providing hygienic-sanitary facilities.

4. Event Participants and all other individuals on the Event Premises are obligated to follow the orders of Security and Information Services, including the head of security. Refusal to comply with these orders may only result from their contradiction with universally applicable laws.

5. Minor individuals attending the Event do so under the exclusive responsibility of their caregivers.

6. Event Participants and all other individuals on the Event Premises are required to conduct themselves in a manner that does not jeopardize the safety of other individuals present at the Event, and in particular, to adhere to the provisions of the Regulations. Prohibited actions include damaging vegetation, littering, destroying signs and informational boards, advertising displays, devices, and equipment on the Event Premises, etc. Participants are obligated to use sanitary facilities solely for their intended purpose.

7. All individuals on the Event Premises are required to have a valid ticket, wristband, or identifier.

8. During the Event, the following items are prohibited from being brought in or possessed:

   - weapons or other dangerous items,
   - explosive materials,
   - pyrotechnic products,
   - fire-hazardous materials,
   - alcoholic and non-alcoholic beverages,
   - food,
   - umbrellas,
   - selfie sticks,
   - drones,
   - intoxicating substances or psychotropic substances,
   - professional cameras and video recorders. Only mobile phone cameras (without megapixel limitations), compact cameras (with non-interchangeable lenses, fixed-focus or zoom), and GoPro-type cameras (without additional lenses and attachments) are allowed.

   Additionally, the introduction of dogs and other animals to the Event Premises, as well as engaging in any commercial or profit-oriented activity on the Event Premises without authorization from the Organizer, is prohibited. The use of drones on or above the festival grounds is also forbidden.

9. The Organizer, within the scope defined by the Act and executive regulations, is authorized to record the course of the Event, particularly the behavior of individuals, using devices capturing images and sound.

10. Security and Information Services, identified by visible identifiers, are authorized according to the Act to:

    a) Check and establish the entitlement of individuals to participate in the Event; in the case of a lack of entitlement, request them to leave the Event.
    
    b) Request identification from individuals for the purpose of establishing their identity.
    
    c) Inspect the contents of the baggage and clothing of individuals if there is suspicion that they possess or are bringing items as mentioned in Chapter IV point 7 of the Regulations.
    
    d) Issue order commands to individuals disrupting public order or behaving contrary to the regulations of the mass event, and in case of non-compliance, request them to leave the Event.
    
    e) Apprehend individuals posing an immediate threat to protected property and those engaging in prohibited actions, for their immediate handover to the Police.

11. Security and Information Services are obliged to remove from the Event Premises individuals whose behavior disrupts public order or violates the Regulations.

12. Members of the Security and Information Services may be equipped, depending on potential risk and needs, with items such as:

    - handheld metal detectors,
    - means of direct force,
    - models of tickets, identifiers, and invitations,
    - other necessary and legally permitted personal protective equipment.

13. The member of the Security and Information Services determines an individual's right to be present at the Event by:

    - checking if the person has a valid ticket, wristband, invitation, or identifier, comparing the presented document with the model.

14. In case of finding items prohibited from being brought in or possessed on the Event Premises during the inspection of bags or clothing, the member of the Security and Information Services denies entry to the event to the person possessing these items or removes them from the Event premises.

15. In case of finding weapons or other dangerous items, alcoholic beverages, explosive materials, pyrotechnic products, fire-hazardous materials, as well as intoxicating and psychotropic substances in the contents of inspected baggage or clothing, the member of the Security and Information Services apprehends the person in possession of these items during the inspection of baggage or clothing. After confiscating the items, the member prepares a protocol of this activity and hands the person over to the Police along with the confiscated items.

16. Individuals who are denied entry to the Event or participation in it, based on the Regulations or the Act, do not have the right to ticket reimbursement or any other claims.

17. Equipment servicing the Event, located on the Event Premises, includes but is not limited to:

    - sound equipment,
    - lighting equipment,
    - gastronomic points and their equipment,
    - workshop points and their equipment,
    - exhibition points and their equipment,
    - barriers (protective barriers),
    - portable toilets.

18. The Organizer does not provide a deposit point.

20. Payments on the Event Premises can be made using credit cards, debit cards, or cash, using electronic devices with proximity technology.

V. RIGHTS AND OBLIGATIONS OF EVENT PARTICIPANTS**

1. Purchased tickets are non-refundable. They may be transferred to another person after prior notification to the organizer. The Organizer reserves the right to cancel the Event without prior notice. The Organizer will not be obligated to provide any compensation or indemnity to the ticket holder except for reimbursing the ticket price printed on the ticket for the canceled Event.

2. The Organizer reserves the right to make changes to the course of the Event for justified reasons, such as Force Majeure, etc. Additionally, the Organizer reserves the right to change the artistic and time schedule of the program without prior consultation and compensation.

3. Event Participants or other individuals present at the Event Premises may be exposed to continuous exposure to high sound levels that could cause hearing damage. Event Participants attend the Event at their own risk. Pregnant women are particularly exposed to potential risks.

4. The Organizer records the course of the Event for documentation, promotion/advertisement of the Event and other initiatives of the Organizer, as well as sponsors of the Event. The image of individuals present on the Event Premises may be captured and subsequently disseminated for documentary, reporting, advertising, and promotional purposes.

VI. COMPLAINTS

1. Any complaints can be submitted in writing no later than 14 days from the end of the Event to the following correspondence address of the Organizer: "Zdalna Fundacja" Foundation, ul. Długa 29, 00-238 Warsaw.

VII. PENAL PROVISIONS ARISING FROM THE LAW ON SAFETY OF MASS EVENTS OF MARCH 20, 2009, Journal of Laws 2009, No. 62, item 504

1. Anyone who fails to comply with an order issued by the security or information services based on the law, facility (premises) regulations, or mass event regulations shall be subject to a fine of not less than 2,000 PLN.

The same penalty shall apply to anyone who is in an area not designated for the public during the duration of the mass event.

2. Anyone who fails to comply with an order issued by the Police or Military Gendarmerie, at the site and during the duration of the mass event, shall be subject to a fine of not less than 2,000 PLN.

3. Anyone who brings or possesses alcoholic beverages at a mass event shall be subject to imprisonment or a fine of not less than 2,000 PLN.

4. Anyone who, when required to do so, does not provide information regarding the safety of a mass event, or provides false information in this regard, shall be subject to imprisonment or a fine of not less than 2,000 PLN.

5. Anyone who brings or possesses firearms as defined in the Act of May 21, 1999, on Firearms and Ammunition (Journal of Laws of 2004, No. 52, item 525, as amended), pyrotechnic products, fire-hazardous materials, or other dangerous objects or explosive materials at a mass event shall be fined not less than 180 daily rates, subjected to imprisonment or deprivation of liberty for 3 months to 5 years.

6. The court may order the forfeiture of objects referred to in point 6, even if they do not belong to the offender.

7. Anyone who throws an object during the duration of a mass event that could pose a threat to the life, health, or safety of persons present at the event site or venue, or disrupts the course of the event in an equally dangerous manner, shall be fined not less than 120 daily rates, subjected to imprisonment or deprivation of liberty for up to 2 years.

8. The penalty referred to in point 8 shall apply to anyone who violates the physical integrity of a member of the security or information services during the duration and at the site of the mass event.

9. If the perpetrator of the acts described in points 8–9 uses an article of clothing or an object to cover their face to prevent or hinder the recognition of their person, they shall be fined not less than 240 daily rates, subjected to imprisonment or deprivation of liberty for 3 months to 5 years.

VIII. FINAL PROVISIONS

1. All rights to the name and logo of the Event are reserved for the Organizer.

2. The status of Event sponsor is exclusively granted by the Organizer.

3. The Organizer shall not be held liable for the consequences of Force Majeure. Force Majeure refers to an event beyond the control of the Organizer that renders the fulfillment of obligations impossible or considered impracticable due to prevailing circumstances. Force Majeure shall include, but is not limited to, weather conditions – including heavy rainfall and strong winds preventing safe stage assembly according to occupational health and safety regulations, breakdowns or disruptions of electricity, heat, and lighting equipment, acts of war, or actions of state or local authorities affecting policy formulation, laws, and regulations that impact the fulfillment of obligations.

4. This Regulation is available:
– on the website www.summerendfestival.com
– at designated entrances to the Event site,
– at the Organizer's office: "Zdalna Fundacja" Foundation, ul. Długa 29, 00-238 Warsaw.

5. Correspondence to the Organizer is directed to the address specified in Section VI, point 1, by written, registered mail.

6. The Security Services may issue their own safety and fire protection instructions in accordance with applicable legal regulations.

7. Matters not regulated by this Regulation shall be governed by the provisions of the Law and the Civil Code.

8. This Regulation enters into force on August 25, 2023.
